US ‘Expert’ Witness not qualified to testify, judge rules

US Circuit Judge, Billy Joe Landrum deemed ‘Expert’ Witness, Pete Perry, chairman of the Hinds County Republican Executive Committee, unfit to testify as an ‘Expert’ due to his lack of qualifications.Perry, who was charging prosecutor, Senator Scottie Cuevas $150 per hour for his 'expertise', was providing evidence that Cuevas lost his November election by a narrow margin due to numerous irregularities, including voting machine malfunctions, voters being turned away from pools and ballots taken home by a Democratic Party Official on election night.His report comprised an exhaustive review of balloting materials, claiming to have expertise in teaching many seminars for poll managers, and that he holds certification to prove it.

However, much to the embarrassment of Senator Cuevas, the blunder came on the first day of trial when Perry admitted he could not remember the title of the certificate and could not produce a copy.Exasperated Judge Landrum, ruled that under Mississippi law, Perry is unqualified. As such, he can testify, but will not be allowed to voice expert opinions."He may be an expert, but he can't qualify as an expert," said Landrum.This case just highlights the stark difference between being a layman and an ‘Expert’ in the eyes of the law.

This is particularly sensitive in US civil trials where one side has utilised an expert to provide such fraudulent testimony as in this political law suit. That difference seems to appear hazy to outsiders.
